Entra in vigore il nuovo codice della strada! Cosa cambia?

La Nuova Legge sulla Strada, che fa parte del CTB (Codice della Strada Brasiliano), ha subito un nuovo aggiornamento – Legge n. 14.599, del 19 giugno 2023. È entrata in vigore il 1° luglio.

Ispezione e applicazione delle sanzioni

Ora, gli enti municipali di transito hanno la competenza esclusiva per vigilare e applicare sanzioni per le infrazioni. Per esempio:

• Velocità;
• Parcheggio irregolare;
• Sovrappeso;
• Ritiro di un veicolo incidentato o abbandonato.

Gli Stati e il Distretto Federale avranno la responsabilità di ispezionare e sanzionare le infrazioni relative a:

• Mancata esecuzione di un esame tossicologico;
• Mancata immatricolazione del veicolo;
• Mancanza di svalutazione irrecuperabile del veicolo;
• Registrazione obsoleta;
• Falsa dichiarazione di domicilio.

Le altre infrazioni saranno di competenza concorrente. Cioè, sia l’uno che l’altro agente possono agire.

La Polizia Militare può svolgere anche attività conclamate di politica del traffico. Ma nel rispetto di quanto spetta alla PRF (Polizia Federale Stradale).

Questa misura è volta a prevenire gli incidenti, oltre a garantire una maggiore sicurezza pubblica e il rispetto del codice della strada.

Questo esame, obbligatorio per i conducenti delle categorie C, D ed E, è uno dei cambiamenti più commentati dai conducenti. Ci sono stati due cambiamenti riguardo a questo tema.

La prima riguarda l’infrazione di cui all’articolo 165-B del CTB: conducente che guida senza aver effettuato l’esame.

In questo caso, l’infrazione continua ad essere rivolta ai conducenti delle categorie C, D ed E. Ma non solo quando sono alla guida di veicoli corrispondenti a tali categorie (ad esempio, camion).

La sanzione per non aver sostenuto l’esame verrà applicata a questi conducenti indipendentemente dal veicolo che stanno guidando.

In questo caso, l’infrazione è di natura molto grave con la sanzione di una multa moltiplicata per cinque volte (R $ 1.467,35). In caso di recidiva entro un termine fino a 12 mesi, si applica la sanzione pecuniaria moltiplicata per dieci e la sospensione del diritto alla guida.

La seconda modifica riguardante la tossicologia è stata la creazione di un nuovo articolo nel CTB: 165-C.

Stabilisce le stesse sanzioni sopra descritte (articolo 165-B) per i conducenti che, anche se non superano il test antidroga, continuano a guidare.

Il Contran (Consiglio Nazionale della Circolazione), con la Delibera 268/23, ha fissato al 28/12/2023 il termine per la regolarizzazione degli esami da parte degli autisti, se scaduti.

D’ora in poi, i vettori, sia persone fisiche che giuridiche, devono obbligatoriamente stipulare tre tipi di assicurazione del carico:

• Responsabilità civile per la copertura di perdite o danni causati da collisione, ribaltamento, ribaltamento, incendio o esplosione;
• Responsabilità Civile per la copertura di furto, furto semplice o aggravato, appropriazione indebita, furto ed estorsione semplice o per sottrazione a danno della merce durante il trasporto;
• Responsabilità civile a copertura dei danni corporali e materiali causati a terzi dal veicolo adibito al trasporto merci su strada.

Importante: sia l’assicurazione contro gli infortuni che quella contro il furto devono essere collegate a RMP (Piani di Gestione del Rischio) stabiliti di comune accordo tra il vettore e il tuo assicuratore.

D’altra parte, il vettore e il proprietario della merce possono stipulare altre assicurazioni.

Il proprietario può anche richiedere al vettore una copia della polizza assicurativa con le condizioni contrattuali, il premio e la gestione del rischio.

Ciclomotori, biciclette elettriche e scooter a motore

La crescita della circolazione di ciclomotori, biciclette elettriche e monopattini a motore ha portato Contran a stabilire regole in merito al loro utilizzo, attraverso la Delibera 996/2023.

I ciclomotori, che devono essere guidati da persone qualificate di categoria A o ACC (Autorizzazione alla Guida di Ciclomotori), devono essere immatricolati e immatricolati come gli altri veicoli.

Inoltre, devono avere tutta l’attrezzatura obbligatoria fornita da Contran (ad esempio: casco con visiera) e viaggiare con la luce scarsa durante il giorno.

Le biciclette elettriche, invece, non necessitano di registrazione e licenza. Ma devono contenere attrezzature, ad esempio:

• campana (corno);
• Dispositivo limitatore di velocità;
• Segnalazione notturna (anteriore, posteriore e laterale);
• Specchietto retrovisore sul lato sinistro;
• Gomme in buone condizioni.

Infine, per quanto riguarda i monopattini elettrici, anche loro non necessitano di patente di guida, né di immatricolazione e patente.

I caschi e gli altri articoli di sicurezza, sebbene essenziali per prevenire lesioni accidentali, devono rimanere a discrezione del conducente.

Il nuovo codice della strada

Negli ultimi anni, il CTB ha subito una serie di cambiamenti. Uno dei più significativi è avvenuto nel 2021, con il cosiddetto Nuovo Codice della Strada.

All’epoca, questa nuova legge modificò e aggiunse diverse regole al Codice. Due anni dopo, ha subito un nuovo aggiornamento.

Tutte le modifiche previste dalla nuova legge sono già entrate in vigore per i conducenti e sono state debitamente inserite nel CTB.
